EDR AccessTM Data Retrieval Services

For Vehicles With Commercially Retrievable EDR Units: Service includes on site access to a vehicle’s event data recorder for the retrieval of data, if any, recorded on the device, and if so, the retrieval of the recorded data, and/or the removal of the event data recorder from the vehicle. If an event data recorder is removed, shipping and handling will be at additional cost. Storage services are also available for at an additional cost.

For Vehicles with EDR Units That are Not Yet Commercially Retrievable: Services include the removal of an EDR unit itself from a vehicle that does not currently have commercially retrievable data, and storage of the EDR unit if and until the data on the EDR unit becomes commercially retrievable off the unit. Under federal law, all manufacturers must provide a commercial means that would enable retrieval of the data stored on all of its EDR units by the year 2011 (most by 2011). Therefore, while a particular vehicle’s EDR unit may not currently have a commercially available means for retrieval, it may be worth removing the entire unit for safe keeping with the goal of downloading that data off the unit once the means becomes available. (Many manufacturers will beat the 2011 deadline, so the wait may be much shorter than 2011. Check our EDR News for manufacturer release dates.)


Available for $375.00 for services within a 60 mile radius of a network harvester, and for vehicles not containing substantial damage that would inhibit access to the EDR unit.

Pricing for services outside the 60 mile radius or for vehicles with damage inhibiting access to the EDR unit will be priced on case-by-case basis prior to services being provided.

Removal, Shipping and Storage of an EDR Unit

At your request, the EDR unit may be removed from the vehicle of interest and sent to either you directly, or stored on our premises for safe keeping until your need for the unit arises.

Cost for removal is at no additional charge.
Shipping and handling fees charged at the going rate.
Storage of a unit is available for $30.00 a year.

LEGAL SUPPORT SERVICES

Collision Data Services offers the following support services to assist in the use of EDR data in a litigation environment. These services are intended to be utilized with the assistance of an attorney. *

CONSENT FORMS
These forms are available at no additional charge when you purchase EDR AccessTM retrieval services. Either consent by the owner of the vehicle or a court order must accompany every order for retrieval services. As disclosed below*, the use of said consent forms is not a substitute for the advice of an attorney. You are encouraged to seek the advice of an attorney before using and/or relying on these forms.

Included with purchase of EDR AccessTM at no additional charge.

CHAIN OF CUSTODY SERVICES

To assist in the development of evidence that provides a detailed chain of where and in whose custody the retrieved data and/or event data recorder resided from the time of retrieval to the time of delivery to the customer or to the place of storage, the following options are available. As disclosed below*, the use of said services is not a substitute for the advice of an attorney. You are encouraged to seek the advice of an attorney before using and/or relying on theses services.

Collision Data Services Affidavit: Collision Data Services will prepare an affidavit in our format that will detail the chain of custody. The format is designed to meet general legal admissibility requirements, but the purchase of this form is no guarantee of the admissibility of EDR data in any particular federal or state jurisdiction, and is subject to the disclosures stated below.*

Available for $75.00 per affidavit.

Affidavit Form Submitted by Others: Collision Data Services will complete an affidavit detailing chain of custody prepared by a third party, subject to legal review, objection and/or revision by our legal counsel.

Available for $150.00 per affidavit.

Collision Data Services Deposition on Written Questions: Collision Data Services will provide written deposition questions that we are prepared to answer in our format that will detail the chain of custody that can be submitted to your court reporter for use in the preparation of the deposition subpoena. The format is designed to meet general legal admissibility requirements, but the purchase of this form is no guarantee of admissibility of EDR data in any particular state jurisdiction, and is subject to the disclosures stated below.*

Available for $75.00 per deposition without cross questions. (An additional $75.00 charge will be accessed if the deposition subpoena is submitted with up to 15 cross-examination or re-direct questions. If cross-examination or re-direct questions exceed 15, the price will be determined on a case-by-case basis.

Deposition on Written Questions Prepared by Others: Collision Data Services will complete a deposition on written questions prepared by a third party, detailing the chain of custody, subject to legal review, objection and/or revision by our legal counsel.

Available for $150.00 per deposition without cross questions. (An additional $75.00 charge will be accessed if the deposition subpoena is submitted with up to 15 cross examination or re-direct questions. If cross examination or re-direct questions exceed 15, the price will be determined on a case-by-case basis.

Oral Deposition: Collision Data Services will cooperate in providing the appropriate witness(s) for deposition on chain of custody issues, but subject to advice of legal counsel. Depositions on issues other than chain of custody are not guaranteed unless accompanied by a court ordered subpoena by a court with jurisdiction over Collision Data Services.

ADDITIONAL LITIGATION SUPPORT FORMS

Motion to Compel Production and Retrieval of EDR Data: This form is available for adaptation to your individual case. It sets forth the basic legal premises and case law supporting the production of a subject vehicle for inspection and retrieval of any data recorded on the vehicle’s event data recorder. It contains legal research that includes case precedent establishing the use of such data in the litigation of cases, although it is not tailored to any particular jurisdiction. As disclosed below*, and subject to said section, the use of said form is not a substitute for the advice of an attorney. You are encouraged to seek the advice of an attorney before using and/or relying on this form, and use of this form is no guarantee that such a motion will be granted and/or will result in a favorable court ruling.
